ICJ stays Kulbhushan Jadhav's execution till final order

Let me tell you, India scored a major diplomatic victory over Pakistan with the International Court of Justice staying the execution of former Indian Navy officer Kulbhushan Jadhav.

On Thursday, Justice Ronny Abraham of the ICJ asserted that the Kulbhushan Jadhav's case was indeed debatable, and added that the ICJ had prime facie jurisdiction in the case.

Zakaria said Pakistan has already informed the ICJ that it does not accept its jurisdiction in matters related to the national security.

While presenting arguments, Pakistani counsel had informed ICJ that Jadhav, 46, was arrested in March previous year in the restive Balochistan province.

The International Court of Justice (ICJ) on 18 May 2017 stayed the execution of Kulbhushan Jadhav till its final decision. "It also unanimously decides that the court must be told of the measures Pakistan takes to implement this order", ICJ President Ronny Abraham said in the operative portion of the order which he read out in the open court for almost 30 minutes.

The Finance Minister, who is in Srinagar to attend the two-day GST Council meeting, said the order issued by the ICJ at The Haque was a vindication of India's stand.

However he said, now Pakistan needs to leave no room open which India can exploit in its favour and forcefully present its case when the same will be heard on merit.

Mr. Salve also said, India's fight for Jadhav rested on the argument of restitution which basically meant that the verdict of the Pakistani military court which found Jadhav guilty needed to be annulled and the trial started afresh.

It also hit out at India, saying the country has been "trying to hide its real face" by taking the case of Jadhav to the ICJ.

According to details, Jadhav can appeal against his death sentence in Supreme Court of Pakistan or to the President Mamnoon Hussain and Chief of Army Staff General Qamar Javed Bajwa. Pakistan has continuously been in denial mode when they said that they will not accept.

Analysts and observers blamed Pakistan's legal team for the setback caused by the ICJ's order. Days before India moved the International Court of Justice, Islamabad had submitted a fresh declaration that narrowed the world court's jurisdiction.
